1. General conditions, scope and validity
1.1. The Terms and Conditions apply to the legal relations between all persons and the shopping environment Estgenic.ee (hereinafter Estgenic) arising from the purchase of products through Estgenic.
1.2. In addition to these terms and conditions, the legal relations arising from the purchase of products through Estgenic are regulated by the legislation in force in the Republic of Estonia.
1.3. Estgenic is entitled to amend and supplement these terms and conditions and the price list due to its development and in the interests of better and safer use. Amendments and supplements to the Terms and Conditions and the Price List shall be notified via the website www.estgenic.ee and amendments and additions to the Terms and Conditions and the Price List shall enter into force as of the publication of the amendment or supplement on the website www.estgenic.ee. If you submitted your order before the changes to the terms came into force, the legal relationship between you and Estgenic will be governed by the terms in force at the time you placed the order, unless otherwise provided by law or these terms.
2.1. Estgenic prices are valid in clause 4.2 of the Conditions. within the time limit for payment of the invoice set out in
2.2. All prices include 20% VAT.
2.3. Purchased products are subject to a transport price (excluding special offers), which is calculated on the product sheet and in your shopping cart.
2.4. If the price / quantity of the product according to the campaign or regular price list is entered incorrectly by Estgenic.ee and the customer is notified before or after placing the customer’s order and Estgenic and the customer do not reach a new price / quantity agreement, Estgenic has the right to withdraw, cancel the customer’s order and refund the amount paid.
3. Shopping cart and ordering
3.1 Your shopping cart will be created the moment you click on the “Order” and “Add product” links.
3.2. You can change the number of products in the shopping cart in the “Quantity” box. To place an order, click on the “Buy Products” link and you will be directed to the ordering page.
3.3. On the ordering page, enter the required information. Select the delivery method and press “Continue” and if you have selected the payment method for the order, press “Order”.
When selecting the payment method “Transfer”, click the “Select” link and then “Order”. After that, a link will appear on the screen where you can open the order you have placed. An order confirmation will also be sent to your e-mail address. After the order is accepted by the administrator, an invoice will be sent to your e-mail address for payment. The order will be executed after the advance payment is received.
If you choose card payment as your payment method, you will be directed to the Nets Estonia card payment terminal, where you will receive a free Master / Visa debit and credit card.
3.4. Be careful when completing the order, because the accuracy and correctness of this information depends on the fast and trouble-free delivery of the products you have purchased.
3.5. The contract for the sale of products is considered concluded (entry into force of the contract) from the moment when 100% of the invoice amount has been paid for the order to the current account of Vessar OÜ, except for in the case of an order with a redemption fee, if the sales contract is deemed to have been entered into as of the moment of placing the order, and in the case of an installment payment, if the contract is deemed to have been entered into after the customer signs the contract.
4. Payment for the order
4.1. It is possible to pay for the products:
By bank transfer on the basis of an invoice
Upon receipt of the goods in cash
Mastecard and Visa by debit or credit card
4.2. The invoice for the products will be paid on the basis of the invoice within 3 days after the invoice is issued. No advance payment is required when paying in “Cash” and the full amount is payable at the Estgenic office (in cash).
4.3. Your order and invoice will be canceled if you have not paid in advance within 3 days of the invoice being issued.
5. Delivery and handover of products
5.1. After the order enters into force in accordance with clause 3.5 of the Conditions. the products will be delivered at the time agreed in advance by the contact telephone number provided by you when placing the order.
5.2. The products together with the product information and other documents accompanying the products will be delivered by the courier within the delivery time specified on the product sheet.
5.3. If the product you have ordered is not in stock and must be ordered from a special supplier and it is obvious that delivery of the product is not possible within the delivery time specified in the product description, and in other cases when delivery is not possible in circumstances for which Estgenic is not responsible , we will notify you of this by contact telephone or e-mail notified by you when placing the order within 3 working days as of the entry into force of the Agreement in accordance with clause 3.5 of the Conditions. and we also inform you about the delivery time of the product you have ordered. If you lose interest in purchasing the product due to a longer delivery time, you have the right to cancel your order (see sections 6.1 and 6.3 for details) and the amount paid by you (including transport costs) will be refunded to you.
5.4. If the products you have ordered have been handed over to the courier company, the courier company will contact you in advance to specify the time of delivery of the products.
5.5. The courier company will deliver the products to the address indicated by you when placing the order. It is not possible to change the destination later.
5.6. Please check the correctness of the contact information provided when ordering to avoid delays and misunderstandings in the delivery of products. Estgenic.ee and the courier company are not responsible for delays in the delivery of products and misunderstandings if the delay or misunderstanding is due to the inaccuracy or inaccuracy of the information provided by you when placing the order.
5.7 Once you have received your parcel, please always check its condition and sign the sales invoice. In cases where you notice any defect upon receipt of the package, write it down on a specific sales invoice. Prepare a free-form report in the presence of a courier, Estgenic delivery point employee, or post office employee describing a defect or defect in the product. If you do not do this, we will not be responsible for:
for a defect caused by the manufacturer;
for the absence of visible parts of the kit which can be observed.
When choosing a convenient delivery method, please make sure you have the required amount in cash.
6. Order cancellation and product return
6.1. You have the right to cancel your order after you have paid for the product but the product has not yet been delivered. To do this, send a corresponding message to the estgenic.ee e-mail address firstname.lastname@example.org with the invoice number and your current account number, or call Estgenic on +372 555 29 085
6.2. After receiving the products, the consumer has 14 days to get acquainted with the products within the meaning of VÕS. If the products are not suitable for the consumer, the consumer has the right to withdraw from his order and return the purchased products within 14 days after the delivery of the products.
6.3. If the order is canceled in the case provided in clause 4.3 or clause 6.1, the amount paid for the purchase (including transport costs) will be refunded to your bank account as soon as possible, but not later than within 14 days from the cancellation, except for clauses 6.4 and 6.2. in the cases provided for in In case of withdrawal from the order in the case provided in clause 6.2, the amount paid for the purchase (including transport costs) will be returned to your bank account as soon as possible, but not later than within 14 days of receiving notice of withdrawal and arrival of returned goods at Vessar OÜ warehouse.
6.4. If the returned product is damaged and the damage is caused by (i) circumstances not due to estgenicus; and (ii) as a result of misuse of the product, estgenic has the right to set off the decrease in the value of the product against the amount paid by you for the product and to be returned to you. To set off, Estgenic will send you a set-off request to your e-mail address. If you do not agree with the decrease in value indicated in the set-off notice, you have the right to involve an independent expert to determine the decrease in value of the product. The costs of the examination will be divided in half between you and Estgenic, unless the position of one of the parties proves to be unfounded. In such a case, the costs of the expert examination shall be borne by the party whose position was found to be unfounded.
7. Warranty and return of non-conforming product
7.2. The documents proving the warranty of the purchased product are all the documents attached by the manufacturer and the sales invoice, which must be submitted for warranty repair. To avoid misunderstandings, please check the documents upon receipt of the products at our point of delivery, stating: product model, date of sale, signatures of the seller and the buyer.
7.3. Before using the goods, please read the instructions carefully and use the product according to the manufacturer’s recommendations.
7.5. In case of non-conformity or defect of the product, you have the right to demand the replacement of the product with a compliant and non-defective product or to withdraw from the order and return the non-compliant product at the expense of Estgenic.ee.- Money Back guarantee!
7.6. In case of returning a non-compliant product, the amount paid for the product (including transport costs) will be transferred to your bank account as soon as possible, but not later than within 14 days of receiving notice of withdrawal and product return request.
The warranty does not cover:
damage caused by improper use of the product or use of the product for purposes not intended;
defects or alleged defects resulting from the use of the product with a product, accessory, software and / or service not manufactured or supplied by the manufacturer or seller and from the fact that the product was combined with such product, accessory, software and / or service, not manufactured or supplied by the seller or manufacturer.
8. Liability and force majeure
8.1. Vessar OÜ is liable to you and you are liable to Vessar OÜ for the damage caused to the other party by the violation of these terms and conditions in the laws of the Republic of Estonia
